Can I really get off probation early?

Yes! But it depends on what offense you are on probation for, the nature of the offense, how much probation you have successfully completed, and how much you have left to do. Under Texas Code of Criminal Procedure art. 42A.701, a person is eligible for early release from probation once they have completed one-third (1/3) of their probation period or two years, whichever is less

What are the requirements to get off probation early? 

In order to receive early termination of probation, the Judge will usually need to see the following things:

The probationer...

  1. Has paid all fines and court costs, unless the probationer does not have the ability to pay;
  2. Has completed all community service hours;
  3. Has completed all classes and programs ordered as conditions of probation;
  4. Has paid any restitution ordered, unless the probationer does not have the ability to pay; and
  5. Has not previously violated their probation* (this is not always a bar to early release, see below).

Additionally, if you have been convicted (meaning you were not placed on deferred adjudication probation) of any of the following, you are not eligible for early termination of probation:

-DWI Offenses;

-Any offense requiring Sex Offender registration;

-Several enumerated felonies, including Murder, Robbery, Kidnapping, Burglary, Injury to a Child;

-You were convicted of another felony and you were found to have used a deadly weapon during the commission of the offense.

How long will it take to get me off probation? 

It can take anywhere from one week on the low end to a month or more on the high end. If you have been perfect on probation, it is generally a quicker process. If you have been not-so-perfect, the process can stretch out longer and require court hearings on the matter. 

What if I have previously violated my probation?

This is not necessarily a barrier to getting off probation early. It all depends on the nature of the violations), the amount of time that has passed since the violations, and your overall efforts to address and fix the issues that led to the violations.
